Bollywood actor Sanjay Dutt eagerly

Bollywood actor Sanjay Dutt eagerly awaits his release (permanently this time) on February 25, 2016, after completion of his jail term.During his stay in jail Dutt got furlough and parole several times and also got remission for his good behaviour paving way for his early release.According to sources, the prison rules entitle each prisoner to get remission for a certain period of time and this is granted to a convict if his behaviour is good during the incarceration. However, there seems to be a hurdle for Dutt as he had surrendered before the jail authorities after a delay of two days when he was released earlier this year. However, the delay was due to a procedural lapse and hence if chief minister Devendra Fadnavis grants him pardon he could be released in February instead of October 2016.Sanjay Dutt, the jail authorities and the government were much criticised as the actor was granted parole and furlough continuously in a short span of time while common prisoners behind bars for even lesser serious crimes than Dutt were denied similar rights. However this time Dutt’s release will be permanent, as he will be coming out of jail after serving his “complete” sentence.

 

The actor had surrendered in May 2013 following a Supreme Court verdict confirming his conviction. After his arrest in 1993, he had already spent almost 18 months in jail so that period was taken into account and he had to spend another 42 months in jail.However, during this period in October 2013, he was released on furlough for 14 days, which was extended by a fortnight. In January 2014, again a 30-daysparole was extended by another 30 days. In December 2014, he was again granted another 14-day furlough. He received another 30-day furlough in August 2015.Earlier, the actor was convicted and sentenced to six years of rigorous imprisonment by the special Terrorist and Disruptive Activities Prevention Act (Tada) court in 2007 for illegally possessing firearms. Though Dutt’s conviction was not good news for his fans, a real-life drama was being enacted in the court. As soon as it was confirmed he would not be able to avoid jail — which would be around 42 months — he made a request to the court that he may be allowed to use a few things in jail, including e-cigarettes.His lawyer had informed the court that he was suffering from few ailments so he may be allowed to use a mattress and eat home cooked food.

 

The actor himself had informed the court at that time that he was a chain smoker and even if he wanted to quit smoking he would not be able to do it at once; hence he should be allowed to use e-cigarettes which would not trouble other inmates and at the same time help him cope with his habit.However special Tada judge Pramod Duttatraya Kode had only allowed him to have home-cooked food for a month and had advised him to quit smoking completely.The actor had challenged this judgment and though the Supreme Court had upheld his conviction, it reduced his prison term to five years.Dutt was facing charges of possessing illegal arms in the 1993 serial blasts case but was acquitted from terror charges and the court had convicted him only under the Arms Act.As the actor is expected to come out of jail in 2016, the Tada court is also likely to decide the fate of the person who is facing the charge of supplying firearms to Dutt the same year, namely gangster Abu Salem.The special Tada court had delivered 1993 serial blasts case judgment in 2007 and Abu Salem was deported from Portugal in 2005.

 

Though at that time the ’93 blasts case was still undecided, it had already been pending for 12 years and hence a decision was taken to separate the trial of those who had been arrested later so the trial does not drag further.Since Abu Salem was also arrested at the fag end of the trial, his trial was separated from Sanjay Dutt and now the second phase of ’93 blasts case will also conclude soon.According to CBI sources, the prosecution has begun its final arguments in the case on December 7. The final arguments begun soon after the defence lawyers completed examining defence witnesses to prove the innocence of the accused.On when the judgment in the second phase trial of ’93 blasts case is expected, a CBI officer on condition of anonymity said, “It is very difficult to anticipate.” He also said, “Public prosecutor had told us that they were expecting to start their final arguments in the case in September 2015, however the defence started calling defence witnesses and now the final arguments have begun in December.”

 

According to him public prosecutors would take about three months to complete the final arguments and there are seven accused who have taken the services of five different lawyers. So the defence lawyers would take time to complete their final arguments and in such a situation the judgment is not expected to come before September 2016 he said.Currently Abu Salem, Mustafa Dosa, Karimullah Khan, Firoz Abdul Rashid Khan, Riyaz Siddiqui, Tahir Merchant and Abdul Qaiyum are facing trial before special judge G.A. Sanap. The prosecution case is that Salem and Abdul Qaiyum had gone to Sanjay Dutt’s house to deliver weapons.Advocates Sudeep Pasbola, Farhana Shah, Khan China waterproof quilting fabrics Manufacturers Abdul Wahab and Rizwan Merchant are the defence lawyers. Advocate Deepak Salvi is the special public prosecutor in the case.
